Case Summary

The Defendants were charged with the killing of 28 residents of Miri, Sarawak. The order for the execution was unlawful for two reasons - the Miri residents did not go to trial and Colonel Aikyo did not have the authority to pass the sentence. The defendants were aware of the unlawful nature of the execution yet did not duly verify if the execution should be carried out.

In the defendants' petition against the death penalty sentence for the first two defendants, the defence lawyer argued that no matter what decision they made about the killing ot the Miri residents, the two defendants could not be free from death.
