Case Summary

The defendant was charged with two counts, both involved committing war crimes. The defendant was employed in the police department at Port Blair, with primarily clerical duties. He was involved in the water torture of Krishna, the first victim, during his interrogation. Krishna died of asphyxia some hours later. With regard to the second charge, about a fortnight before the incident concerning Krishna, the defendant had interrogated an Indian cook, Surat Singh, on a charge of accepting bribes from the patients of Bamboo Flats Hospital Port Blair for supplying them with extra food. The defendant severely beat Surat Singh for about 20 minutes and then administered the water torture to him in order to extort a confession that he had accepted the bribes. The water torture was applied to the extent that the victim died of asphyxia some hours later.
